By creating an account or using MyProMarketer (the "Service"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Service. These terms constitute a legally binding agreement between you and Telvara Ventures LLC ("Company," "we," "us," or "our").
MyProMarketer is a subscription-based marketing content service. Each month, we research your business and generate a customized marketing kit that may include a promotional calendar, social media captions, email newsletter drafts, SMS copy, review responses, and Google Business posts. Content is delivered digitally via your account dashboard.
You may cancel your subscription at any time through your billing portal or by contacting us at contact@mypromarketer.app. Cancellations take effect at the end of your current billing period. No partial-month refunds are issued. After cancellation, your account and kit history remain accessible until the end of your paid period.
All marketing content generated for your account ("Your Content") is owned by you upon delivery. You grant us a limited, non-exclusive license to use your business information, logo, and review data solely for the purpose of generating your kits.
We do not sell or share your business content with third parties. Content generated for your account is specific to your business and is not reused for other customers.
You agree not to use the Service to:
We reserve the right to suspend or terminate accounts that violate these terms without refund.
Kit content is generated automatically based on publicly available information about your business. While we aim for accuracy and quality, you are responsible for reviewing all content before publishing it. We make no guarantees about the accuracy, completeness, or fitness of generated content for any particular purpose. Always review and edit content before use.
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your information as described therein. We do not sell your personal data. For questions, contact us at contact@mypromarketer.app.
To the maximum extent permitted by law, Telvara Ventures LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost revenue, or loss of business — arising from your use of or inability to use the Service. Our total liability to you for any claim arising out of or relating to these terms or the Service shall not exceed the amount you paid us in the 3 months preceding the claim.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
We may update these Terms at any time. When we do, we will update the effective date at the top of this page and notify active subscribers via email at least 14 days before changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Bexar County, Texas. You waive any objection to jurisdiction or venue in those courts.
